Child Custody and Parenting Time

Domestic Violence Restraining Orders
Unfortunately, family or domestic violence and child abuse are prevalent issues in family law. A parent may seek protection for themselves and/or their children if they (the parent or the child) were subject to abuse, or if the child witnessed abuse.
A petition seeking protection must be filed with the court, then temporary orders pending a hearing might be issued. These orders can include provisions for:
- No contact
- Specified distance that must be maintained between the parties and/or the child and the restrained person
- Orders for one party to move out of a shared residence.
A temporary order of protection doesn’t guarantee the issuance of a long-term restraining order because the opposing party hasn’t yet had an opportunity to present their evidence and their story.

Legal Separation
A legal separation is similar to a divorce in that it allows the parties of a marriage to divide their assets and debts, to address spousal maintenance, and to address child custody if applicable.
However, because a legal separation doesn’t dissolve the status of the marriage, the parties aren’t returned to “single” status. Although still being legally married will prevent either party from remarrying until the legal separation is converted into a dissolution, it provides benefits that aren’t available in a divorce such as maintaining health insurance and other social security benefits.
